كتاب اللطلاق للشافعي والتعقيب علي ما قال الشافعي رحمة الله عليه
مسند الشافعي[[وَمِنْ كِتَابِ الطَّلَاقِ
أَخْبَرَنَا مُسْلِمٌ، وَعَبْدُ
الْمَجِيدِ، عَنِ ابْنِ جُرَيْجٍ، عَنِ ابْنِ طَاوُسٍ، عَنْ أَبِيهِ، أَنَّ أَبَا
الصَّهْبَاءِ قَالَ لِابْنِ عَبَّاسٍ: «إِنَّمَا كَانَتِ الثَّلَاثُ عَلَى عَهْدِ
رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ تُجْعَلُ وَاحِدًا، وَأَبِي
بَكْرٍ، وَثَلَاثٍ مِنْ إِمَارَةِ عُمَرَ» . فَقَالَ ابْنُ عَبَّاسٍ: نَعَمْ
أَخْبَرَنَا مُسْلِمُ بْنُ خَالِدٍ، وَعَبْدُ الْمَجِيدِ، عَنِ ابْنِ جُرَيْجٍ، عَنْ مُجَاهِدٍ قَالَ: قَالَ رَجُلٌ لِابْنِ عَبَّاسٍ: " طَلَّقْتُ امْرَأَتِي مِائَةً، قَالَ: تَأْخُذُ ثَلَاثًا، وَتَدَعُ سَبْعًا وَتِسْعِينَ "

أَخْبَرَنَا مَالِكٌ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ قَالَ: " كَانَ الرَّجُلُ إِذَا طَلَّقَ امْرَأَتَهُ ثُمَّ ارْتَجَعَهَا قَبْلَ أَنْ تَنْقَضِيَ عِدَّتُهَا كَانَ ذَلِكَ لَهُ وَإِنْ طَلَّقَهَا أَلْفَ مَرَّةٍ، فَعَمَدَ رَجُلٌ إِلَى امْرَأَةٍ لَهُ فَطَلَّقَهَا ثُمَّ أَمْهَلَهَا حَتَّى إِذَا شَارَفَتِ انْقِضَاءَ عِدَّتِهَا ارْتَجَعَهَا ثُمَّ طَلَّقَهَا وَقَالَ: وَاللَّهِ لَا آوِيكِ إِلَيَّ، وَلَا تَحِلِّينَ أَبَدًا، فَأَنْزَلَ اللَّهُ تَعَالَى: {الطَّلَاقُ مَرَّتَانِ فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحٌ بِإِحْسَانٍ} [الْبَقَرَة: 229] ، فَاسْتَقْبَلَ النَّاسُ الطَّلَاقَ جَدِيدًا مِنْ يَوْمَئِذٍ، مَنْ كَانَ مِنْهُمْ طَلَّقَ أَوْ لَمْ يُطَلِّقْ "

أَخْبَرَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا أَنَّهُ [ص:193] سَمِعَهَا تَقُولُ: جَاءَتِ امْرَأَةُ رِفَاعَةَ يَعْنِي الْقُرَظِيَّ إِلَى رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَقَالَتْ: إِنِّي كُنْتُ عِنْدَ رِفَاعَةَ فَطَلَّقَنِي فَبَتَّ طَلَاقِي، فَتَزَوَّجْتُ بَعْدَهُ عَبْدَ الرَّحْمَنِ بْنَ الزُّبَيْرِ، وَإِنَّمَا مَعَهُ مِثْلُ هُدْبَةِ الثَّوْبِ، فَتَبَسَّمَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَقَالَ: «تُرِيدِينَ أَنْ تَرْجِعِي إِلَى رِفَاعَةَ؟ لَا، حَتَّى يَذُوقَ عُسَيْلَتَكِ، وَتَذُوقِي عُسَيْلَتَهُ» . وَأَبُو بَكْرٍ عِنْدَ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، وَخَالِدُ بْنُ سَعِيدِ بْنِ الْعَاصِ بِالْبَابِ يَنْتَظِرُ أَنْ يُؤْذَنَ، فَنَادَى: يَا أَبَا بَكْرٍ، أَلَا تَسْمَعُ مَا تَجْهَرُ بِهِ هَذِهِ عِنْدَ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ

أَخْبَرَنَا عَبْدُ الْمَجِيدِ بْنُ عَبْدِ الْعَزِيزِ، عَنِ ابْنِ جُرَيْجٍ، أَخْبَرَنِي أَبُو الزُّبَيْرِ، أَنَّهُ سَمِعَ عَبْدَ اللَّهِ بْنَ أَيْمَنَ يَسْأَلُ ابْنَ عُمَرَ، وَأَبُو الزُّبَيْرِ يَسْمَعُ: كَيْفَ تَرَى فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ حَائِضًا؟ فَقَالَ: طَلَّقَ عَبْدُ اللَّهِ بْنُ عُمَرَ امْرَأَتَهُ وَهِيَ حَائِضٌ عَلَى عَهْدِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَسَأَلَ عُمَرُ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَنْ ذَلِكَ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «مُرْهُ فَلْيُرَاجِعْهَا» . فَرَدَّهَا عَلَيَّ وَلَمْ يَرَهَا شَيْئًا، فَقَالَ: «إِذَا طَهُرَتْ فَلْيُطَلِّقْ أَوْ لِيُمْسِكْ»

أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ،
عَنِ ابْنِ عُمَرَ، أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ عَلَى عَهْدِ
النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَسَأَلَ عُمَرُ رَسُولَ اللَّهِ
صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَنْ ذَلِكَ، فَقَالَ رَسُولُ اللَّهِ صَلَّى
اللهُ عَلَيْهِ وَسَلَّمَ: «مُرْهُ فَلْيُرَاجِعْهَا، ثُمَّ لِيُمْسِكْهَا حَتَّى
تَطْهُرَ ثُمَّ تَحِيضَ، ثُمَّ إِنْ شَاءَ أَمْسَكَ، وَإِنْ شَاءَ طَلَّقَ قَبْلَ
أَنْ يَمَسَّ، فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ عَزَّ وَجَلَّ أَنْ
يُطَلَّقَ لَهَا النِّسَاءُ»
أَخْبَرَنَا مُسْلِمُ بْنُ خَالِدٍ،
عَنِ ابْنِ جُرَيْجٍ، أَنَّهُمْ أَرْسَلُوا إِلَى نَافِعٍ يَسْأَلُونَهُ: هَلْ
حُسِبَتْ تَطْلِيقَةُ ابْنِ عُمَرَ عَلَى عَهْدِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ
وَسَلَّمَ؟ فَقَالَ: نَعَمْ

1.خروج الزوجين من محيط الزوجية دون ارهاصات نفسية تدور دائرتها في نفوس الازواج المطلقين بالشكوك الحالية والمستقبلية خاصة الأزواج في بعضهما مثل احتواء الارحام علي شيئ من النطف الزوجية
2=. او إعطاء الزوجين فرصة لاستبعاد الغضب والتهور واتخاذ القرار الصائب جدا بالامساك او الفراق
